Women have made significant strides in all aspects of life over the years, including the workplace. However, there are still instances where men and women are treated differently by their employers whether through differing pay scales, promotion criteria or performance expectations.
The state of California provides that employees are entitled to overtime pay, if they meet certain requirements. Any employee that is classified as non-exempt and over the age of 18 may not work over eight hours in any day or 40 hours in any week without receiving overtime pay for the excess hours worked. Overtime pay is one and a half time the employee's regular pay.
Employees in California are afforded various rights via federal and state law. Among them is protection from retaliation by their employer in the event that they file a complaint regarding the company or one of its other employees. Regardless of the cause of the complaint or whether it is filed internally or with an external agency, an employer cannot commit any adverse action against an employee in response.
Age-based legal protections are provided by the Age Discrimination in Employment Act, which provides rights to those forty and over regarding discriminatory activities by employers. These protections are provided not only to current employees, but also extend to those applying for jobs.
